Constellation Speech Therapy's Privacy Policy

At Constellation Speech Therapy, we are committed to respecting your privacy. Constellation Speech Therapy (Orthophonie Constellation) is required by law to take measures to keep your health information and records safe. All personal health information that we obtain will be protected in accordance with Act Respecting the Protection of Personal Information in the Private Sector (Loi sur la protection des renseignements personnels dans le secteur privé) (chapter P-39.1), Personal Information Protection and Electronic Documents Act (PIPEDA), and/or the Personal Health Information Protection Act in Ontario (PHIPA, 2004, S.O., c.3, Schedule A). These are acts concerning the protection of personal information held, collected, used, and communicated to a third party.

 

Consent

Throughout the course of service, Constellation Speech Therapy (Orthophonie Constellation) must connect, use, and disclose personal information about its clients. Constellation Speech Therapy will only collect, use, and disclose personal health information with your consent. You have the right to withhold and/or withdraw consent at any time. Your personal health information will not be shared with third parties without obtaining your consent. It is necessary that the parent/guardian of a minor child be present for all interactions with Constellation Speech Therapy, or that the parent/guardian allow us to work with supportive personnel by consenting to share information with them. Such supportive personnel may include (but are not limited to) daycare staff, school staff, and supportive personnel hired to provide support to children in the speech and language program in the community. By choosing to obtain services from Constellation Speech Therapy in a setting outside of the home and without the minor child’s parent/guardian being present, such minor child’s parent/guardian shall be deemed to have consented to allowing Constellation Speech Therapy to share all necessary personal health information with the minor child’s supportive personnel throughout the course of our provision of services.

 

There are situations where we may become legally or ethically obligated to share your personal information without your consent. Such situations may include search warrants/subpoenas issued to obtain client information, and in relation to a concern regarding the safety of a child (i.e. suspicion of abuse, mistreatment, neglect). These situations may be reviewed in the applicable legislation.

 Types of Personal Information Collected

 

The personal health information that Constellation Speech Therapy collects about you will depend on the manner in which you access the website, or the type of service provided.

 

Personal information may include (but is not limited to):

  • Identifying information (e.g., full name, phone number, address, date of birth, contact for parent/guardian, emergency contact, e-mail address, and other similar information associated with you);

  • Your location, time zone setting, network information, device type, browser type and version, browser plug-ins and versions, language, IP address or similar identifier, access or use of our website;

  • Reports regarding relevant health and medical history;

  • Reports from other professionals (e.g., Speech Pathologist, Occupational Therapist, Physiotherapist, Psychologist, Doctor);

  • Our own records regarding assessment, recommendations, intervention plans, progress notes, progress reports, meeting summaries with parents/guardians and other professionals;

  • Any relevant insurance information, bills and receipts, and information to process payments for services rendered.

  • Any other personal information that you choose to submit to us.

 

Methods For Collecting Personal Information

 

Personal Information Constellation Speech Therapy collects from you on or through the website may include information that you provide directly or indirectly.

  • Information provided directly includes, but is not limited to, submitting, posting, or publishing content generated by you, filling in forms, search queries related to Constellation Speech Therapy, phone calls, emails, text messages, or other electronic messages.

  • Indirect information is gathered through technological collection methods, which include but are not limited to, cookies which gather information regarding the device or equipment you use, how you interact with the website, location data, IP address, operating system, and browser type. You can turn off cookies using your internet browser settings, but doing so may impact the functionality of the website.

 

Third Party Features on Website

 

Constellation Speech Therapy's website may include, or rely upon links, plug-ins, social networks, or other third-party applications. Your access or use of such third-party features may allow these third-party providers to collect or share information about you, some of which may be personal information. Personal Information Usage

 

Your personal information may be used to:

  • Guide our assessment and intervention;

  • Contact you to discuss services, schedule appointments, etc.;

  • Invoice for services provided;

  • Advise you of upcoming events or opportunities;

  • Inform third parties, to which you have provided consent, of assessment findings, progress, plans of intervention, etc.;

  • Confirm the date, type, cost and provider of services if requested by your insurance company (as applicable). No other personal information will be shared with your insurance company without your written consent;

  • Comply with the request of regulatory bodies (e.g., College of Audiologists and Speech-Language Pathologists of Ontario (CASLPO), Ordre des orthophonistes et audiologists du Quebec (OOAQ), to inspect the records of registered members.

 

We only keep personal health information that is necessary for us to meet our professional obligations. Only team members (e.g., clinicians, administrative staff, students, volunteers) involved in your care are allowed to view the contents of your file. These team members are also responsible to use and protect your information in accordance with the law. Your information is kept in confidential files (stored in a locked cabinet and/or using a secure server). This information is collected, retained, stored, used, shared, and destroyed in compliance with the above legislation as well as in compliance with our regulatory bodies. External consultants (including, but not limited to, bookkeepers, accountants, and lawyers) may consult personal information after entering into a privacy agreement with Constellation Speech Therapy. Electronic information is transmitted only after having obtained your consent. Paper information that is transmitted with your consent to third parties shall be sealed, marked “private and confidential” and delivered by a reputable carrier.

 

We will communicate with you using the phone number(s) and/or email addresses provided. It is your responsibility to make sure you provide up-to-date contact information if these details should change.

 

Access and Correction of Personal Health Information

 

Your personal health information belongs to you. You are allowed to request a copy of your file, and, if justified, you are permitted to request changes be made to correct or modify information contained in your file. If you request a copy of your file, access is free (beyond the cost for copying/sending) and must be provided within a reasonable period of 20 business days. You must provide a written notice, signed, and dated, to request a copy of your file.

 

We follow provincial laws in terms of retaining client data. After the provincially mandated timeframe, all information is destroyed in a confidential and permanent manner.

 

We reserve the right to make changes to our Privacy Policy (as contained herein). Changes will be reflected on the Constellation Speech Therapy Website (www.constellationspeechtherapy.ca/privacy-policy) You may withdraw your consent with written notice (signed and dated) at any time. This may result in changes to the services that can be provided. The risks and benefits of this decision will be discussed.
